1. Scope and provider

These terms of use apply to the use of the mobile app Train-With.me (Android and iOS) and the website train-with.me (together “the service”). The provider is:

By registering for or using the service you agree to these terms of use.

2. Description of the service

Train-With.me is a free social sports app: you can share activities with friends, see when friends work out, arrange meetups via chat and view your training statistics. There is no entitlement to specific features, uninterrupted availability or freedom from errors. We may develop, change or discontinue the service at any time.

3. User account

Using the app requires an account. You agree to provide truthful information when registering and to keep your credentials confidential. Use is permitted from the age of 14; younger children need the consent of a parent or guardian. Only one account per person is permitted.

4. Rules of conduct and content

You are responsible for the content you share via the service (e.g. activities, comments, chat messages, profile picture, username). Prohibited are, in particular, unlawful, insulting, threatening, discriminatory or misleading content as well as advertising, spam and the infringement of third-party rights. Attempts to manipulate or overload the service or to automatically scrape other users' data are also prohibited.

In case of violations we may remove content and temporarily suspend or permanently delete accounts.

5. Rights to content

Your content remains yours. You merely grant us the simple, revocable right to store it and display it to the intended recipients as part of the service (e.g. your activities to your confirmed friends, your public profile at train-with.me/u/<username>).

6. Sport at your own risk

Train-With.me facilitates meetups between users but is neither the organizer nor the supervisor of shared workouts. Sporting activities – alone or with others – are undertaken at your own responsibility and risk. Please assess your health and fitness level realistically and meet up with people you trust.

7. Liability

For the service provided free of charge, we are only liable for damage caused by intent or gross negligence and for personal injury in accordance with statutory provisions. Liability for slight negligence, loss of profit and consequential damage is excluded to the extent permitted by law. We accept no responsibility for content posted by other users.

8. Termination and account deletion

You can delete your account at any time directly in the app (Settings → Delete account) or request deletion by emailing support@train-with.me. We may terminate the user relationship with reasonable notice, and without notice in case of serious violations of these terms.

9. Changes to these terms

We may amend these terms of use, for example for new features or changes in the law. We will inform you of material changes in the app or by email. The current version is always available on this page.

10. Final provisions

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods and conflict-of-law rules. For consumers this applies only insofar as it does not deprive them of the protection of mandatory provisions of their country of residence. Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
